Terms of Service

These Terms of Service ("Terms") govern your use of the FieldQ platform at fieldq.uk (the "Service"), operated by FieldQ ("we", "us", "our"). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the company you represent.

1. The Service

FieldQ is a web-based construction snag management and site inspection platform. It provides defect tracking, PDF inspection forms, drawing pins, time tracking, reporting and compliance record export ("Golden Thread"). The Service is provided to business customers; it is not intended for consumers.

2. Accounts and responsibilities

• You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account.
• Company administrators control which users have access to their account and what those users can see and do. You are responsible for managing your own team's access, including removing users who leave your organisation.
• You must not use the Service for any unlawful purpose, attempt to gain unauthorised access to other accounts, or interfere with the operation of the Service.

3. Free trial

New accounts receive a 30-day free trial with full access to the Service. A payment card is required to start the trial, but it will not be charged during the trial period. You may cancel at any time during the trial from your account settings and you will not be charged. If you do not cancel, your paid subscription begins automatically when the trial ends.

4. Subscription and payment

• The Service costs £99.99 per month, covering unlimited projects and unlimited team members on your account.
• Payment is taken monthly in advance by card via our payment processor, Stripe. Prices are exclusive of VAT where applicable.
• There is no minimum term. You may cancel at any time from your account settings; you keep access until the end of the period you have already paid for, and you will not be charged again.
• We may change our pricing with at least 30 days' notice to your account administrator. Price changes take effect at your next billing cycle after the notice period.

5. Fair usage — storage

Each account includes 50GB of file storage (photos, drawings, documents and PDF forms) within the standard subscription. If your account exceeds 50GB, additional storage is billed automatically at £25 per month for each additional 150GB block in use. Your uploads are never blocked — when your usage crosses a storage threshold, the add-on is applied to your subscription and your account administrators are notified. If your usage later drops back below a threshold, the corresponding charge is removed at the next billing cycle. Current usage is always visible on your billing page.

6. Your data

• You own your data. All project content you upload or create — snags, photos, forms, drawings, documents — remains yours. We claim no ownership over it.
• We process your data only to provide the Service, as described in our Privacy Policy.
• You are responsible for ensuring you have the right to upload the content you add to the Service.
• You can export your compliance records (Golden Thread PDF) at any time. On account closure, we will make your data available for export for a reasonable period before deletion.

7. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted availability. We may occasionally suspend access for maintenance, and we will try to schedule this outside normal UK working hours. We are not liable for outages caused by events beyond our reasonable control.

8. Compliance records

FieldQ provides tools designed to support Building Safety Act 2022 record-keeping, including timestamped audit trails and Golden Thread export. However, responsibility for regulatory compliance remains with you. FieldQ is a record-keeping tool, not a substitute for professional or legal advice on your compliance obligations.

9. Intellectual property

The Service, including its software, design and branding, is owned by us and protected by intellectual property laws. We grant you a non-exclusive, non-transferable right to use the Service for your business purposes while your subscription is active.

10. Limitation of liability

Nothing in these Terms excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential losses, loss of profit, or loss of data caused by circumstances beyond our reasonable control, and our total aggregate liability arising from the Service in any 12-month period is limited to the amount you paid us in that period.

11. Termination

• You may cancel your subscription at any time as described in section 4.
• We may suspend or terminate an account that seriously or repeatedly breaches these Terms, or where required by law. Where practical, we will give notice and an opportunity to remedy the breach first.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to account administrators at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
